LS Adaptive, LLC and its parents, subsidiaries, and affiliates ("LS Adaptive," "we," "us," "our") operate this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). LS Adaptive is powered by Shopify, which enables us to provide the Services to you.

This Privacy Policy ("Policy") explains how we collect, use, disclose, and retain information when you visit our websites or use our platforms and applications. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described in this Privacy Policy.

This Policy applies to Personal Information (also called "personal data"), meaning information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an individual. This Policy does not apply to aggregated or de-identified information that cannot reasonably be linked to an individual.

  • Communications with us including the information you include in communications with us, for example, when sending a customer support inquiry or review.

  • Other information you choose to provide (for example through forms, chat, or reviews), including birth date if provided.

Information collected automatically:

  • Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.

  • Usage information including information regarding your interaction with the Services, date/time of access, referring/exit pages, and how and when you interact with or navigate the Services.

Information from affiliates/partners:

We may receive information related to you through our affiliates and service providers that support our operations (for example, commerce hosting, payment processing, analytics, and customer support).

We use Personal Information to: (a) provide and operate the Services (including purchases and customer support); (b) communicate with you; (c) personalize your experience; (d) send marketing communications where permitted (you can opt out); (e) perform analytics and improve the Services; (f) protect security and prevent fraud; and (g) comply with law and enforce our policies.

We use cookies and similar technologies to operate the Services, remember preferences, understand usage, and measure the effectiveness of communications.

Where required by law, we use Shopify’s customer privacy tools to display a cookie banner and allow you to manage certain cookie preferences. You can also control cookies through your browser settings (blocking some cookies may affect functionality). We do not respond to “Do Not Track” signals because there is no consistent industry standard for compliance.

6. How we disclose Personal Information

We do not sell or rent your Personal Information. We may disclose Personal Information:

  • to our affiliates;

  • to service providers that perform services on our behalf (for example: hosting, commerce functionality, payment processing, customer support, analytics, promotions, and marketing communications);

  • to comply with law or respond to lawful requests (such as subpoenas or court orders);

  • in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets; and

  • in aggregated or de‑identified form.

We do not share your Personal Information for cross‑context behavioral advertising (targeted advertising) at this time.

7. Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside.

To help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes.

The Services are not intended to be used by children under the age of majority in your jurisdiction, and we do not knowingly collect Personal Information from children under 13 (or the applicable age of majority).

If you are the parent or guardian of a child who has provided us with their personal information, you may contact us at wecare@lsadaptive.com to request that it be deleted.

As of the date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

We use reasonable safeguards designed to protect Personal Information. However, please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." No network (including the internet) is entirely secure. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

How long we retain your Personal Information depends on different factors, such as whether we need the information to maintain your account, provide you with Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies. Some information may be retained longer as required by law, contract, auditing requirements, or to establish, exercise, or defend legal claims.

We use reasonable safeguards designed to protect Personal Information. However, no network (including the internet) is entirely secure.

Your Personal Information may be processed in the United States and other jurisdictions that may not provide the same level of protection as your country of residence. We take appropriate steps to protect Personal Information consistent with this Policy and applicable law.

Depending on where you live, you may have some or all of the following rights in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

  • Delete - Request that we delete personal information

  • Correct - Request correction of inaccurate personal information

  • Opt out of Sale or Sharing for Targeted Advertising - Direct us not to share information about you to show you targeted advertisements based on your online activity. You can exercise this right HERE.

  • Appeal - Appeal certain decisions we make regarding your requests

Global Privacy Control: If you visit our website with the Global Privacy Control opt-out preference signal enabled, depending on where you are, we will automatically treat this as a request to opt-out for the device and browser that you use to visit the website. If we can associate the device to a Shopify account, we will apply the opt-out request to the account as well. Learn more at https://globalprivacycontrol.org/. Other than Global Privacy Control, we do not recognize other "Do Not Track" signals.

We may need to verify your identity before fulfilling a request. You may designate an authorized agent to make requests on your behalf. We will require proof of authorization and may need you to verify your identity directly with us. We will not discriminate against you for exercising any of these rights. We will respond to your request in a timely manner as required under applicable law.

If you have complaints about how we process your personal information, please contact us at wecare@lsadaptive.com. Depending on where you live, you may have the right to appeal our decision by contacting us, or lodge your complaint with your local data protection authority.

15. Marketing preferences

You can stop receiving promotional emails by clicking the unsubscribe link in the email. You cannot opt out of service-related messages (such as order and account notices).

16. Changes to this Policy

We may update this Policy from time to time. The “Updated” date at the top indicates when it was last revised.
